A wrongful death case is litigated generally on a contingency contract, just like any personal injury case. Often, you’ll see advertisements on television of, “We don’t get paid unless you get paid,” or, “We won’t make a penny unless we recover for you.” And that’s the concept of the contingency contract, and that is that when you sign a contract with a lawyer on a contingency basis, you are essentially giving that attorney 33 1/3% before suit, and 40% if suit if filed, of your eventual recovery.
