Of course, the level of responsibility is going to vary depending upon what the circumstances are. A crosswalk, obviously, is a notice to the motorist that people are crossing in that particular area and therefore greater weight is given to the responsibility of the operator of the motor vehicle than the pedestrian. But if the pedestrian is visible, the pedestrian always has the right-of-way, no matter where they’re crossing.
